SPELL SALVAGE 

LOVED TO DEATH

GARMENT TAKEBACK PROGRAM

 

1.          The “SPELL Salvage” Loved to Death Garment Takeback Program (“Program”) is an Extended Producer Responsibility (“EPR”) Program conducted by SPELL Designs Pty Ltd (ABN 68 605 908 496) (“SPELL”) of Unit 1, 14A Banksia Drive, Byron Bay, NSW, Australia, 2481.

 

2.          Instructions on participation in the Program to return and salvage your loved-to-death SPELL garments and other details, including the terms and conditions below are, available online at https://aus.spell.co/pages/spell-salvage.

 

THE PROGRAM

 

3.    The Program is only available and open to SPELL customers exclusively based in Australia.

 

4.    To be participate, individuals must, follow the below processes either In-Store or via our Online store process:

 

4.1  Deposit In Store

i)      Bring your clean SPELL garments to our Byron Bay Store at 15 Browning Street, Byron Bay, NSW;

ii)    Our staff will fill assess garments and fill out form and deposit clean SPELL garments,

iii)    SPELL will issue a “Gift Card” worth $20 per 1 item. Gift card will be sent to participant via email.

iv)    Once received, gift card may be used in store or online.

 

4.2  Deposit to our Online store (via Post)

            Navigate to our website at https://aus.spell.co/pages/spell-salvage

(i)      Fill out the online SPELL Salvage Request Form (“Salvage Form”).

(ii)    Once approved by SPELL a shipping label will be sent via email. SPELL covers the shipping cost of items returned for SPELL Salvage.

(iii)    Participant must provide their own mailer. We recommend reusing some old packaging you already have lying around or choosing a recyclable or compostable option, if possible.

(iv)    Attach shipping label to mailer.

(v)    Total weight of parcel must not exceed 3kg.

(vi)    Drop parcel in Australia Post office or mail collection box.

(vii)  Once received, items will be assessed, and a gift card will be sent to email address included on original Salvage Form.

(viii) SPELL will issue a gift card worth the value of $20 per 1 item returned.

(ix)    Once received, gift card may be used in store or online.

 

5.    By completing the Spell Salvage Form, you agree to join our SPELL email database and join to receive store updates in relation to your garment, as well as opt-in to receive marketing and sales communications from SPELL. You may opt-out and unsubscribe at any time from our SPELL email database in accordance with the Privacy Act 1988 (Cth).

 

6.    Clothing deposit exclusions:

(i)    SPELL is unable to accept intimates, swim, accessories due to hygiene and textile recycling limitations. SPELL is unable to receive clothing in-person deposits to SPELL Headquarters or Warehouse locations.

(ii)  All items deposited must be authentic SPELL items and counterfeits. Non SPELL branded items will not be accepted.

 

7.    SPELL reserves the right to assess the quality of the SPELL Garments as per the above conditions and determine the final condition and treatment of the SPELL Garment(s).

 

8.    You may salvage as many items and as many times as you like.

 

9.    Gift Cards are valid for three (3) years from the date of issue. Gift cads can be redeemed online at aus.SPELL.co or in our Byron Bay Store before expiry.

 

10.  In the event that, for any reason whatsoever, a participant does not accept the gift card at the time that clothing is deposited, gift card will be forfeited and cash will not be awarded in lieu of the gift card.

 

11.  Participants release and waive any claims they may have against SPELL for any and all injuries, claims, damages, losses, costs, or expenses of any kind (including without limitation legal costs) resulting from acceptance, use, or misuse of any gift card or element thereof, or participation in this program.  Participants indemnify SPELL against any loss or damage resulting from any breach of the warranties in these rules.

 

12.  Where the information you are asked to provide to SPELL is personal information it is protected by the Privacy Act 1988 (Cth). SPELL will not disclose this information to other parties other than in accordance with the Privacy Act 1988 (Cth). Personal information provided by an entrant to SPELL for the purpose of entering the Program will be collected, used and disclosed in accordance with SPELL’s Privacy Statement. Personal information collected will be kept strictly confidential and will not be sold, reused, rented, loaned or otherwise disclosed to any third party otherwise than in accordance with the SPELL Designs’ privacy statement and these Terms and Conditions.

 

13.  All participants who choose to ‘opt-in’ consent to have their contact details (first name, surname, email), will receive marketing material and correspondence from SPELL Designs as the purpose of collection of personal information.

 

14.  SPELL reserves the right to withdraw or amend the Program or these terms and conditions, as necessary at any time. We will publish any amendments to this Program on our website at https://aus.spell.co/pages/spell-salvage.

 

15.  All clothing deposits become and remain the property of SPELL Designs Pty Ltd (ABN 68 605 908 496) and any related entities and agencies associated with this Program.
